The English version of these terms and policies controls. Spanish and French translations are provided for convenience and should be reviewed by qualified counsel before commercial launch.
Important: ArbSoul does not claim ownership of your customer, property, tree, photo, report, or client-contact information. You grant only the limited rights needed to run, secure, support, and improve ArbSoul.
1. Free public beta
ArbSoul is pre-release software. During the public beta, eligible Tree Inventory, Tree Risk Assessment, Tree Appraisal, Planting, Landscape Design, Client Portal, synchronization, and professional-report features are offered without a subscription or report allowance. We may add, remove, suspend, or change beta features as we learn from testing.
We will give reasonable notice before introducing paid access for existing beta users. Joining the beta does not require a future purchase.
2. Accounts and authorized use
You must be at least 18 and able to enter this agreement. You are responsible for your login, activity under your account, and the accuracy of information you submit. You may upload information only when you have the legal right and appropriate professional or client authorization to do so.
Workspace owners control invitations and roles. Client users may add notes, photos, and flags, but cannot change an arborist's professional findings.
3. Customer Data remains yours
"Customer Data" includes account, client, property, map, location, tree, plant, measurement, condition, risk, valuation, price, recommendation, note, photo, logo, credential, report, and related information submitted through ArbSoul.
You retain all rights you have in Customer Data. You grant ArbSoul a non-exclusive, worldwide, royalty-free license to host, copy, transmit, format, display, analyze, back up, and otherwise process Customer Data only as reasonably necessary to:
- provide synchronization, mapping, reports, portals, sharing, and other requested features;
- protect accounts, investigate errors, prevent misuse, and maintain service reliability;
- provide support and respond to requests;
- test, measure, develop, and improve ArbSoul; and
- create aggregated or de-identified statistics that do not reasonably identify a person, client, property, or workspace.
This license ends when the data is deleted, except for limited backups, legal obligations, security records, and genuinely de-identified information.
4. Client relationship protection
ArbSoul will not sell your client-contact information, use it to market ArbSoul directly to your clients, solicit your clients for arboricultural or landscape services, or intentionally bypass your business relationship.
ArbSoul may contact a client only when the client contacts us, when you or an authorized workspace user directs the communication, to deliver a client-requested service or security notice, or when reasonably required by law, safety, fraud prevention, or account protection.
5. Professional responsibility
ArbSoul organizes field information and assists with calculations and reports. It is not a substitute for professional judgment, a site inspection, applicable standards, legal advice, engineering advice, or an arborist's duty of care. You remain responsible for verifying species, measurements, risk ratings, appraisal inputs, calculations, recommendations, prices, maps, and final reports before relying on or sharing them.
Beta users should keep reasonable backups and promptly report defects that could affect safety, valuation, or client work.
6. Feedback and beta reliability
If you send suggestions, bug reports, workflow ideas, or other feedback, you allow ArbSoul to use that feedback without payment or restriction to develop, test, market, and improve ArbSoul. This permission does not transfer ownership of Customer Data included in the feedback.
To find beta defects, ArbSoul may automatically collect privacy-limited reliability signals described in the Privacy Policy. These signals are designed to identify app releases, affected modules and device categories, and recurring failure fingerprints without collecting professional records, client content, locations, photos, credentials, or raw error messages.
7. Service changes and termination
The beta may be unavailable, incomplete, or contain defects. We may suspend access to protect users, data, or the service. You may stop using ArbSoul at any time and can initiate account deletion from Account & Data settings. We may terminate accounts used unlawfully, abusively, or in ways that threaten other users or the platform.
Third-party services
ArbSoul relies on services such as Supabase, Netlify, Google Maps, Apple, Google authentication, Firebase, and Stripe. Their separate terms may apply to their services.
8. Disclaimers and limits
To the maximum extent allowed by law, the beta is provided "as is" and "as available" without warranties of uninterrupted operation, merchantability, fitness for a particular purpose, or non-infringement. ArbSoul is not responsible for professional decisions, field conditions, tree failure, property damage, lost profits, or indirect, incidental, special, consequential, or punitive damages arising from beta use.
To the maximum extent allowed by law, ArbSoul's total liability relating to the free beta will not exceed USD $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
Governing law
These terms are governed by Ohio law, without regard to conflict-of-law rules, except where mandatory local consumer law applies. Before any formal claim, both sides agree to attempt a good-faith resolution through the ArbSoul feedback and privacy-request channel.
Changes
We may update these terms as the beta evolves. Material changes will be presented for acceptance in the app. Continued use after acceptance means the updated terms apply.
